Translate Go User Agreement

Effective Date: October 10, 2024

By using or accessing the products, software, data feeds, and services provided to you by Translate Go, you agree to these terms and conditions. If you do not agree to any of these terms, please do not use the Service. The Service is provided by Translate Go on an "as is" and "as available" basis, and Translate Go reserves the right to modify, suspend, or terminate the Service at any time in its sole discretion without notice. You agree to be bound by such modifications. Translate Go shall not be liable for any modification, suspension, or termination of the Service.

Service

These Terms of Service apply to all users of the Service, including users who are also contributors of content to the Service. "Content" may include text, software, graphics, photos, sounds, music, videos, audio-visual combinations, interactive features, and other materials you may view on, access through, or contribute to the Service. The Service includes all aspects of Translate Go, including, but not limited to, all products, software, and services made available through the Translate Go Application. The Service may contain links to third-party websites that are not owned or controlled by Translate Go. Translate Go has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites. In addition, Translate Go does not and cannot review or edit the content of any third-party websites. By using the Services, you expressly release Translate Go from any and all liability arising from your use of any third-party websites. Accordingly, we encourage you to be alert when you leave the Services and to read the terms and conditions and privacy policies of each other website you visit.

Disclaimer

The Services are provided on an "as is" basis. Translate Go and its suppliers, licensors, and affiliates hereby disclaim all warranties, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement. Translate Go and its suppliers and licensors do not warrant that the Services will be error-free or that access to the Services will be continuous or uninterrupted. You understand that you download from or otherwise obtain content or services through the App Store entirely at your own discretion and risk.

Limitation of Liability

In no event will Translator.com, its suppliers or licensors, be liable with respect to any subject matter of this Agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement or substitute products or services; (iii) interruption of use or corruption or loss of data; or (iv) any increase in the fees paid by you to Translator.com under this Agreement in the twelve (12) months prior to the date of the cause of action. Translator.com shall not be liable for any failure or delay due to matters beyond its reasonable control. The foregoing does not apply to the extent prohibited by applicable law.

Translator.com Premium Subscription

With Translator.com Premium Subscription, you get access to all features and payment will be charged to your iTunes Account at confirmation of purchase. Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. Account will be charged for renewal within 24 hours prior to the end of the current period, and identify the cost of the renewal. Subscriptions may be managed by the user and auto-renewal may be turned off by going to the user's Account Settings after purchase. To cancel your subscription, you can go to your device's Settings > iTunes & App Store, tap your Apple ID, tap View Apple ID, tap Subscriptions, tap Cancel Subscription for the app. If a free trial period is offered, any unused portion will be forfeited when the user purchases a subscription to that publication, as applicable. All fees and charges are non-refundable. If you would like to cancel your subscription, switch to a different premium service package, please contact us. You are responsible for the content you post and distribute on the Translate Go application. You warrant that you own or have the necessary licenses, rights, consents and permissions to post the content. You agree not to post and create any premium listings that violate our Terms of Service. Translate Go reserves the right to remove listings without prior notice and fees or charges will not be refunded. You understand that if you violate the Terms of Service, your subscription or access to the content on the website will be suspended. Suspended accounts cannot be restored and fees or charges will not be refunded.

General Use of the Service

The Fast Translator hereby grants you permission to access and use the Service as provided in these Terms of Service, provided that: You agree not to distribute any part of the Service or Content in any media without the prior written authorization of the Fast Translator, unless the Fast Translator provides the means for such distribution through the functionality provided by the Service. You agree not to change or modify any part of the Service. You agree not to access the Content through any technology or means other than the download page of the Service itself or other expressly authorized means that the Fast Translator may specify. You agree not to use the Service for any of the following commercial purposes, unless you obtain the prior written approval of the Fast Translator: to sell access to the Service; to sell advertising, sponsorship or promotion on or within the Service or Content; or to sell advertising, sponsorship or promotion on any page of an advertising blog or website that contains Content provided through the Service, unless other materials not obtained from the Fast Translator appear on the same page and are of sufficient value to be the basis for such sale. Prohibited commercial uses do not include: uploading original materials to the Fast Translator, or maintaining an original profile on the Fast Translator, to promote your business or enterprise; any use expressly authorized in writing by the Fast Translator. You agree not to create, post, publish or distribute to Translate Go any content of any type that is determined, in Translate Go's sole discretion, to be commercial, illegal, offensive or potentially harmful to others, including, but not limited to, content that: infringes upon the rights of any third party, including, but not limited to, copyright, trademark, patent, trade secret, design right, moral right or other third party proprietary right, including rights of privacy and publicity. The files/content should not contain third-party copyrighted material, or material that is subject to other third-party proprietary rights, unless you have permission from the rightful owner of the material or you otherwise have the legal right to publish the material and grant the Translate Go all of the license rights granted herein; promote infringement of copyright or other third-party rights, such as providing a list of hyperlinks to websites containing pirated software or media files, hacking/cracking, etc.; contain any inappropriate, incorrect and false content, with different content previews and titles; duplicate or contain the same files and content that already exist on the Translate Go; contain software viruses or any other malicious computer code, files or programs designed to interfere with, destroy or change the functionality of any computer software or hardware or telecommunications equipment owned by another party; attack, abuse, threaten, harass, stalk, promote violence, racism, harm, hatred or bigotry against any group or individual; defame, slander or promote information that you know is false or illegal; invade the privacy of others, including but not limited to posting photos of others without their consent; send messages to people under 18 solicit information from anyone under the age of 18; be obscene, sexually explicit, or contain nudity; be or contain advertising, marketing plans, business solicitations, or other content that is materially related to any commercial purpose; be illegal or of an illegal, criminal, or tortious nature (e.g., child pornography, fraud, gambling). You will comply with all applicable laws when using the Services. Translate Go reserves the right to discontinue any aspect of the Services at any time.

Use of Content

In addition to the general restrictions above, the following restrictions and conditions specifically apply to your use of the Content. All brands, product and service names used in the Services that identify Translate Go or third parties and their products and services are proprietary trademarks of Translate Go and/or relevant third parties. Nothing in the Services shall be deemed to grant to anyone Translate Go or any third party any license or right to any such images, logos, or names. The Content is provided to you as is. You may access the Content only for your reference and personal use through the functionality provided by the Services and as permitted in these Terms of Service. You may not download any Content unless you see a "download" or similar link displayed by Translate Go on the Services for that Content. You may not copy, reproduce, distribute, transmit, broadcast, display, sell, license or otherwise exploit any Content for any other purpose without the prior written consent of Translate Go or the respective licensors of the Content. Translate Go and its licensors reserve all rights not expressly granted in and to the Services and the Content. You agree not to circumvent, disable or otherwise interfere with security-related features of the Services or features that prevent or restrict the use or copying of any Content or that impose limitations on the use of the Services or the Content therein. You understand that in using the Services, you will be exposed to Content from a variety of sources and that Translate Go is not responsible for the accuracy, usefulness, safety or intellectual property rights of such Content. You further understand and acknowledge that you may be exposed to Content that is inaccurate, offensive, indecent or objectionable, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against Translate Go in connection therewith, and, to the extent permitted by applicable law, agree to indemnify and hold harmless Translate Go, its owners, operators, affiliates, licensors and licensees to the maximum extent permitted by law for all matters relating to your use of the Services.

Content and Conduct

As an account holder of Translate Go, you may submit Content to the Service. You understand that Translate Go does not guarantee the confidentiality of any Content you submit. You are solely responsible for your own Content and the consequences of submitting and posting Content on the Service. You affirm, represent and warrant that you own or have the necessary licenses, rights, consents and permissions to publish the Content you submit; and that you authorize Translate Go to publish all patent, trademark, trade secret, copyright or other proprietary rights in such Content on the Service in accordance with these Terms of Service. You retain all ownership rights in the Content. However, by submitting Content to Translate Go, you hereby grant Translate Go a worldwide, non-exclusive, royalty-free, sublicensable and transferable license to use, reproduce, distribute, prepare derivative works of, display and perform the Content in connection with the Service and Translate Go's (and its successors and affiliates') business, including without limitation for promoting and redistributing part or all of the Service (and derivative works thereof) in any media formats and through any media channels. You also hereby grant each user of the Service a non-exclusive license to access your Content through the Service and to use, copy, distribute, display and perform such Content as permitted by the functionality of the Service and these Terms of Service. The above license granted by you in Content submitted to the Service will terminate within a commercially reasonable time after you remove or delete the video from the Service. However, you understand and agree that Translate Go may retain, but may not display, distribute or perform, server copies of the removed or deleted Content. You further agree that Content submitted by you to the Service shall not contain third-party copyrighted material or material subject to other third-party proprietary rights, unless you have permission from the rightful owner of the material or you otherwise have the legal right to post the material and grant Translate Go all of the license rights granted herein. Translate Go does not endorse any Content submitted to the Service by any user or other licensor, or any opinion, recommendation or advice expressed therein, and Translate Go expressly disclaims any and all liability related to the Content. Translate Go does not permit copyright and intellectual property infringement activities on the Service and will remove all Content if Translate Go receives proper notice that such Content infringes the intellectual property rights of others. Translate Go reserves the right to remove Content without prior notice. Translate Go has no control over the Content you upload, post or otherwise transmit using the Service and has no obligation to monitor such Content for any purpose. You acknowledge that you are solely responsible for all Content and materials you upload, post or otherwise transmit using the Service.

Account Termination

Translate Go will terminate a user's access to the Service if, under appropriate circumstances, the user is determined to be a repeat infringer. Translate Go reserves the right to determine whether Content violates these Terms of Service for reasons other than copyright infringement, including but not limited to pornography, obscenity. Translate Go may remove such Content and/or terminate a user's account for submitting such material that violates these Terms of Service at any time in its sole discretion, without prior notice.

Firebase

Translate Go may use different services to verify receipt of subscription status. The service we implement is Firebase. Translate Go uses Firebase to obtain products, make purchases, and check subscription status.

Ability to Accept Terms of Service

You confirm that you are at least 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations and warranties set forth in these Terms of Service, and to abide by and comply with these Terms of Service.

Transfer

These Terms of Service, and any rights and licenses granted under these Terms of Service, may not be transferred or assigned by you, but may be transferred or assigned by Translate Go without restriction.
